Read this first — the short version

TV App is an app for tracking the TV shows, movies and documentaries you watch. Most of it runs entirely on your own iPhone and needs no account at all. If you choose to sign in with Apple, you can also follow friends, comment on episodes, upvote comments and vote for the best character in an episode. That social layer is where other people can see what you post — and where these Terms matter most.

The parts you should not skip:

  • There is a zero-tolerance policy for objectionable content and abusive users. See Section 5.
  • Comment text is screened before it is posted, and you can report any comment, report any user, and block any user from inside the App. See Section 6.
  • Reports are reviewed by a human and acted on within 24 hours, and offending users are ejected. See Section 7.
  • You can delete your account and everything you have shared, from inside the App. See Section 11.
  • The App is provided "as is", with no warranties, and liability is limited. See Section 14 and Section 15.

This summary is for convenience only. The full text below governs.

1. Acceptance of these Terms

These Terms of Use ("Terms") form a binding agreement between you and Monty Inc ("we", "us", "our") covering the TV App iPhone application, its home-screen widget, and any related services we operate (together, the "App").

By downloading, installing, opening or using the App, you agree to these Terms. If you do not agree, do not use the App, and delete it from your device.

If you use the App's social features, you additionally agree to the rules in Sections 4 through 8. Those rules are a condition of access: breaking them can cost you your account.

These Terms and our Privacy Policy are linked from inside the App, under Settings → Legal, and a line beneath the Sign in with Apple button records that signing in means you agree to both. You can read either document at any time without signing in, at https://tvapp.montyinc.net.

We may update these Terms. When we do, we will change the effective date at the top and post the current version at https://tvapp.montyinc.net. Material changes will be surfaced in the App or announced at https://tvapp.montyinc.net before they take effect. Continuing to use the App after an update means you accept the updated Terms. If you do not accept them, stop using the App and delete your account.

2. Who may use the App

You may use the App only if you can form a binding contract with us under the law of your country.

You must be at least 13 years old, or at least 16 if the law where you live sets a higher minimum age for using an online service on your own account. The App carries an App Store age rating of 12+; that rating describes the content, while the minimum age above is a condition of this agreement, and where the two differ the higher figure applies to you.

The App is not directed to children and is not offered in the Kids Category. It hosts user-generated content — free-text comments, user-uploaded photos and third-party GIFs. Comment text is screened before it is posted (Section 6.1), but screening is imperfect and does not read images, so you may still encounter content you find objectionable. Report it and block the user; see Sections 6.2 and 6.3.

We do not knowingly allow anyone below the minimum age to create an account. If you believe someone below the minimum age has created an account, contact info@montyinc.net and we will remove it.

You are responsible for everything that happens under your account, and for keeping access to your Apple ID and device secure.

3. What the App does, and what it does not do

Local by default. Your library — the shows and movies you follow, your watch dates, your per-episode ratings, your play counts and your settings — is stored in a database on your own device. You can use the entire tracking side of the App without ever creating an account: following shows, marking episodes watched, rating them, tracking movies and documentaries, local new-episode notifications, the home-screen widget, importing an export from another TV tracking app and exporting a backup file all work signed out.

Signing in is optional. Sign in with Apple is the only sign-in method, and it exists solely to unlock the social features: your public profile, following people, the activity feed, community episode ratings, "friends who watched", best-character votes and episode comments.

What signing in shares. When you are signed in, the episodes you mark watched and the ratings you give them are mirrored to our backend so that people who follow you can see them, and so the App can compute community averages and recommendations. When you first sign in, your existing local library is backfilled to the server for the same reason. Comments you post are visible to every signed-in user, not only to your followers. Photos you attach to comments are stored in a publicly-readable location and are retrievable by anyone who has the URL, even without an account. Do not post a photo you would not be comfortable being publicly accessible.

Ratings are per-episode. The App rates individual episodes. There is no show-level rating and no private notes or review feature.

What the App does not do. The App does not play video, does not link to or provide streaming, does not tell you where a title is available to stream, and does not offer direct messages. Movies and documentaries are tracked locally only and have no social layer. There is no cloud restore of your library — moving to a new phone means exporting a backup file yourself.

Not a backup service. We are not a storage or backup provider for your library. Your library lives on your device. Deleting the App, losing the device, or a device failure can lose it permanently. Export a backup file if it matters to you.

4. Your content and the rules for posting

"Your Content" means anything you submit, upload, post or transmit through the App: comment text, photos you attach to comments, GIFs you select, upvotes, best-character votes, your username and display name, your reports, and the watch activity that is shared with your followers when you are signed in.

You are solely responsible for Your Content. You represent that you own it or have the rights to post it, and that posting it does not break the law or infringe anyone's rights.

4.1 What you must not post

You must not post, upload, transmit or link to content that:

  • is threatening, harassing, bullying, stalking or intimidating, or that targets a person for abuse;
  • is hateful or demeaning toward a person or group on the basis of race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, age or serious disease;
  • is sexually explicit or pornographic, or is otherwise sexual content involving or appearing to involve a minor in any form, ever — this is an absolute prohibition and is reported to the appropriate authorities;
  • depicts or glorifies gratuitous violence, gore, self-harm, suicide or eating disorders;
  • promotes, facilitates or instructs on illegal activity, terrorism, violent extremism, or the sale of drugs, weapons or other regulated goods;
  • discloses another person's private information — home address, phone number, email address, government identifiers, financial details — without their consent, or otherwise doxes or surveils someone;
  • impersonates another person, brand or Monty Inc itself, including through your username or display name;
  • infringes copyright, trademark, publicity or privacy rights, including posting screenshots, stills or photographs you have no right to distribute;
  • is spam, bulk-posted, scraped, automated, fraudulent, phishing, a scam, or advertising;
  • contains malware, malicious links, or attempts to break, probe or overload the App or our backend;
  • provides, requests or links to pirated media, unlicensed streams or the means to obtain them;
  • is deliberately posted as a spoiler in order to ruin something for other people (see 4.3); or
  • is otherwise objectionable in our reasonable judgement.

Attempting to defeat the screening described in Section 6.1 — by spacing out, misspelling, substituting characters for, or otherwise disguising prohibited content — is itself a breach of this Section.

4.2 GIFs come from a third party

The GIF picker in the comment composer searches GIPHY, a service that we do not own, operate or control. Your phone does not call GIPHY itself: the App sends your search to our own server, which asks GIPHY and passes the results back. GIPHY results are requested with GIPHY's PG-13 rating filter applied, but that filter is GIPHY's, it is imperfect, and we do not pre-screen what it returns. Our own screening reads comment text; it cannot read the content of a GIF.

By using the GIF picker you agree that:

  • when you search for a GIF, your search text goes to our server and on to GIPHY, and GIPHY's terms and privacy policy apply to that request. Our server also caches the search text and the results, keyed by the text alone and not by you — see the Privacy Policy;
  • a GIF you attach to a comment is not copied to our servers — it stays hosted by GIPHY and is loaded from GIPHY's servers every time anyone views your comment, which means GIPHY receives a request from every viewer;
  • because the GIF is hosted by GIPHY, its content can change or disappear at any time without our involvement, and we cannot delete it from GIPHY — deleting your comment removes the comment, not the underlying GIPHY asset;
  • you are responsible for the GIF you choose exactly as if you had written the words yourself. Selecting an objectionable GIF is a violation of these Terms, and the same enforcement applies; and
  • if you encounter an objectionable GIF returned by search, report the comment it appears in (Section 6.2) and, if you wish, report it to GIPHY through GIPHY's own reporting route.

The same applies to any other third-party imagery surfaced in the App: posters, stills and backdrops come from third-party metadata providers and are not ours.

4.3 Spoilers

Comments live on individual episode pages, so people reading them have generally chosen to be there. Even so: do not post plot details from later episodes or seasons than the page you are on, and do not use spoilers to provoke people. Deliberate spoiler-bombing is treated as harassment under Section 4.1.

4.4 Usernames and display names

Your username and display name are visible to every signed-in user. They are subject to all of the rules above. We may reclaim, reset or change a username that impersonates someone, that is used to abuse or evade a block, that is offensive, or that squats on a name in bad faith.

5. ZERO-TOLERANCE POLICY FOR OBJECTIONABLE CONTENT AND ABUSIVE BEHAVIOUR

Monty Inc operates a zero-tolerance policy for objectionable content and for abusive users.

There is no warning quota and no three-strikes rule. Content that violates Section 4.1 is removed as soon as we become aware of it, and the user who posted it is ejected from the social features of the App — immediately and permanently in the case of anything involving minors, credible threats of violence, doxxing, or sexual content, and at our discretion up to and including permanent removal for everything else.

This applies to comments, comment photos, selected GIFs, usernames, display names, character votes and any other user-submitted content or behaviour in the App. It applies whether the content was blocked by our screening, reported by another user, or found by us. It applies regardless of whether you believe you were joking.

Abusive behaviour includes not only what you post but what you do: mass-following to harass, creating new accounts to evade a block or a ban, coordinated brigading of another user, or using the friend-finding features to locate and target someone.

We do not need to prove intent in order to act, and we may act before we contact you. Enforcement decisions are ours to make — but they are not unappealable: whenever we remove your content or restrict your account, we will tell you what we did and why, and you may appeal, unconditionally, under Section 11.2.

6. How we filter content, and how you report and block

The App gives you three independent protections: automatic screening before a comment is posted, reporting, and blocking. Reporting and blocking are both available from inside the App, with no need to contact us first.

6.1 Screening before a comment is posted

Comment text is screened at the moment you submit it, before it is posted. A comment that fails screening is refused: it never reaches our servers, and no other user ever sees it. A comment is refused if it:

  • matches our blocklist of hate slurs, child-exploitation terms and pornographic spam terms. The check is designed to survive the usual evasions — spaced-out or punctuated letters, repeated letters, accents, zero-width characters, digit and symbol substitutions, and look-alike characters borrowed from other alphabets — so a disguised spelling is refused exactly as the plain spelling is;
  • contains more than two distinct links. Repeats of the same address count once, so a trailer and a background link alongside your own words are fine; a list of links is not. Nothing else about a comment's shape — how much of it is link, or how long a run of repeated characters it contains — will refuse it; or
  • exceeds the 2,000-character limit on a comment.

The App also limits you to five comments per minute. This limit runs inside the App on your device, not on our servers: it smooths out bursts, but it starts over whenever you sign out or the App restarts, so treat it as a brake on accidental flooding rather than a guarantee against a determined one. Deliberately flooding a thread is a breach of these Terms in its own right and is dealt with under Section 5.

Two limits on this, stated plainly. First, screening reads text. It cannot read the content of a photo you attach or a GIF you select; those are governed by Sections 4.1 and 4.2 and by reporting. Second, no automated filter catches everything, and ours is deliberately narrow so that ordinary discussion of dark or adult television is not blocked. Screening is a first line of defence — it does not replace reporting, blocking, or the human review described in Section 7.

6.2 Reporting content and users — in-app

There are two report actions inside the App:

  • Report a comment. Every comment posted by another user carries a Report action. Open the menu on the comment and choose Report.
  • Report a user. Every user profile carries a Report user action, for behaviour that is not confined to a single comment — an abusive username, a pattern of harassment, or block evasion.

Either report is submitted immediately to our moderation queue and records what you reported, the user concerned, and the fact that you reported it.

You may report for any of the reasons in Section 4.1. You do not need to justify it, and the person you report is not told who reported them.

You can also email info@montyinc.net at any time — for example for an urgent safety issue, or anything the in-app report flow does not cover. Please include the username and, where possible, the show and episode. Reports sent by email are treated exactly the same as in-app reports.

Filing knowingly false or automated reports in order to harass someone is itself a violation of these Terms.

6.3 Blocking abusive users

Every user profile carries a Block action, and blocking is also available from the menu on a comment.

When you block someone:

  • their comments stop being visible to you, and yours stop being visible to them;
  • any follow relationship between you is severed in both directions, immediately;
  • neither of you can follow the other again while the block stands; and
  • their activity disappears from your feed and yours from theirs.

Blocking is entirely yours to control, takes effect immediately, requires no approval from us, and does not need to be justified. You can block someone whether or not you also report them, and we encourage you to do both when someone is abusive. Blocking someone does not notify them.

You can unblock later if you choose. Circumventing a block — by creating a new account, or by asking someone else to relay content — is a violation of Section 5 and grounds for permanent removal.

7. Our 24-hour commitment

We review every report of objectionable content and act on it within 24 hours of receiving it.

Acting on a report means, as appropriate to what we find:

  1. removing the offending content from the service;
  2. ejecting the user who provided the offending content — suspending or permanently terminating their account, which removes their content, their profile and their ability to post; and
  3. where the content involves an imminent threat to someone's safety or the exploitation of a minor, referring the matter to law enforcement.

Every report is reviewed by a human. If a report turns out to be unfounded, we take no action against the reported user and we do not penalise you for having reported in good faith.

Twenty-four hours is our commitment for reviewing and acting on reports. Together with the screening and rate limit in Section 6.1, it is how we keep the social layer usable — but it is not a claim that we monitor the service continuously, and screening does not extend to photos or GIFs. We may also remove content, restrict features or terminate accounts on our own initiative, without any report, at any time.

If you have reported something and 24 hours have passed with no visible result, email info@montyinc.net and reference the show, episode and username.

8. Licence you grant us for Your Content

You keep ownership of Your Content. We claim no ownership over your comments, your photos, your ratings or your watch history.

To operate the App, you grant Monty Inc a worldwide, non-exclusive, royalty-free, transferable and sublicensable (only to the service providers who host and deliver the App) licence to host, store, reproduce, transmit and display Your Content for the limited purpose of running the App and showing your content to the people it is meant for, namely:

  • your watch activity and episode ratings — displayed to you, and to the people who follow you;
  • your comments, attached photos, selected GIFs and comment upvotes — displayed to signed-in users of the App, since episode comment threads are open to all signed-in users;
  • your best-character votes — used in anonymous, aggregated tallies shown to all users, with your individual vote visible only to you and the people who follow you;
  • your username and display name — displayed wherever your content or your profile appears; and
  • your episode ratings and watch counts — included in anonymous, aggregated community figures (for example an episode's community average rating, or how many people watched a show) that cannot be traced back to you individually.

This licence exists only so the App can function. We do not use Your Content to advertise, we do not sell it, we do not license it to third parties for their own purposes, and we do not train models on it.

The licence ends when the content does. When you delete a comment, un-watch an episode, clear a rating, unfollow a show or delete your account, the corresponding content is deleted from our systems and the licence over it ends, except for (a) anonymous aggregate figures that no longer identify you, (b) copies we are legally required to retain, and (c) copies that already exist in our infrastructure provider's routine backups or logs and that expire on their own schedule.

We may remove or refuse to display any of Your Content at any time under Sections 5, 6.1 and 7.

9. Licence we grant you for the App

Subject to your compliance with these Terms, Monty Inc grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to install and use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and the Usage Rules in Apple's Licensed Application End User License Agreement — including any additional devices and Family Sharing accounts those Usage Rules allow.

This is a licence, not a sale. We and our licensors retain all right, title and interest in the App, including its software, design, interfaces, name and logos.

You must not:

  • copy, modify, adapt or create derivative works of the App, except as this licence allows;
  • reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, underlying ideas or algorithms of the App, except to the strict extent that applicable law expressly permits despite this restriction;
  • remove, obscure or alter any proprietary notice;
  • rent, lease, lend, sell, redistribute, sublicense or transfer the App;
  • use the App's backend other than through the App itself — no scraping, no unauthorised clients, no automated querying, no attempt to access other users' data, no attempt to bypass rate limits, screening or access controls, and no testing of the security of our systems without our written permission;
  • use the App to build a competing product or dataset; or
  • use the App for any unlawful purpose, or in any way that damages, disables or impairs it for anyone else.

If you violate this section, this licence terminates automatically.

10. Third-party data, third-party services, and no affiliation

10.1 Where the metadata comes from

Show, episode, movie and documentary information in the App — titles, air dates, seasons and episode numbers, synopses, cast and crew, networks, runtimes, artwork, posters, stills and viewer ratings — is supplied by third-party data sources. Those sources are: TVmaze (used under the Creative Commons Attribution-ShareAlike licence), Apple's iTunes Search API, and — only if you choose to add your own API key — TMDB. GIFs come from GIPHY.

This information may be incomplete, out of date, or simply wrong. Air dates change and are sometimes announced incorrectly. Episode numbering differs between sources. Artwork can be missing or mismatched. Runtimes are approximate, so any statistic the App calculates from them — your total time watched, for example — is an estimate and nothing more. Curated lists inside the App, such as an all-time top-rated rail, are hand-maintained selections and are not a live feed from any ratings service.

We provide this information as a convenience, we do not verify it, and we make no warranty of any kind about its accuracy, completeness, currency or fitness for any purpose. Do not rely on the App for anything that matters — including whether or when something is going to air.

Notifications about upcoming episodes are scheduled on your device from this same third-party data. They may fire late, early, or not at all, and iOS limits how many can be pending at once. They are a convenience, not a guarantee.

10.2 No affiliation or endorsement

Monty Inc and TV App are independent. We are not affiliated with, sponsored by, endorsed by, certified by, or connected in any way to:

  • any television network, studio, production company, distributor, or rights holder whose programmes appear in the App;
  • any streaming or video-on-demand service;
  • TV Time (Whip Media Group) — a separate and unrelated TV-tracking product. TV App can import a data export that you obtained from that app, but we are not connected with it, not authorised or endorsed by it, and not a successor to it;
  • TVmaze, GIPHY, TMDB, or any other metadata, image or content provider;
  • Apple Inc., other than as an App Store developer and as set out in Section 17; or
  • any person, cast member or crew member named in third-party metadata shown in the App.

All programme titles, network names, logos, artwork and other trademarks — including "TV Time", which is a mark of Whip Media Group — are the property of their respective owners and are used in the App or in these Terms for identification and reference only. Their appearance does not imply any relationship with, or endorsement of, Monty Inc or the App.

Where a data provider requires it, attribution appears in the App and at https://tvapp.montyinc.net. Specifically: TV data is provided by TVmaze.com and used under CC BY-SA; movie and documentary information and artwork come from Apple's iTunes Search API and Apple does not endorse the App; GIF search is powered by GIPHY; and if you supply your own TMDB key, this product uses the TMDB API but is not endorsed or certified by TMDB.

10.3 Third-party services generally

The App communicates with third-party services to function, and those services receive at minimum your device's IP address and the specific request being made. Their terms and privacy practices govern their handling of that data, and we are not responsible for it.

You must comply with any applicable third-party terms. By using the App you agree to abide by the terms of service of the third-party services the App relies on, to the extent those terms apply to you as an end user — GIPHY's terms when you search for, select or post a GIF; Apple's App Store Terms of Service and Sign in with Apple terms; TVmaze's terms and the CC BY-SA licence conditions attaching to its data; and TMDB's terms if you supply your own TMDB key. If you supply your own API key for an optional provider, you are responsible for complying with that provider's terms, and you accept that the key is stored on your device and sent only to that provider.

If you export a backup file from the App, where it goes — Files, iCloud Drive, mail, another app — is your choice and your responsibility. We never upload it.

11. Ending your account

11.1 By you

You can leave at any time, in two different ways:

Sign out. Signing out ends the session on your device. It does not delete anything from our servers, and signing back in restores your profile as it was.

Delete your account. Settings → Account → Delete account, behind two confirmations. This permanently deletes, from our servers: your profile, your username and display name, the hashed email address used for friend discovery, every follow relationship in both directions, your activity feed entries, your mirrored watch history and episode ratings, your comments, every photo you uploaded to a comment, your comment upvotes and the upvotes on your comments, your best-character votes, your push notification token, your blocks in both directions, the reports you filed, and the reports other users filed about you — reports about you are attached to your account and are removed with it.

Two things to understand about deletion:

  • Your on-device library is not touched. Your shows, episodes, watch dates, ratings and movies stay on your phone and keep working exactly as they did before you ever signed in. If you want to erase those too, delete the App from your device.
  • GIFs you attached to comments are hosted by GIPHY, not by us. Deleting your account removes your comment; the GIPHY asset is unaffected because it was never ours.

Deletion is immediate and irreversible. We cannot restore a deleted account. If you sign in with Apple again afterwards, you get a new, empty account.

You can also delete individual things without deleting your account: deleting a comment also deletes any photo attached to it; un-watching an episode removes it from your mirrored history and removes the matching feed entry; clearing a rating removes the rating entry; and unfollowing a show removes every server-side watch record and feed entry for that show.

11.2 By us

We may suspend or terminate your account, remove your content, or restrict your access to the social features — with or without prior notice, and at our sole discretion — if:

  • you breach these Terms, and in particular Sections 4, 5 or 9;
  • we determine, following a report, our screening, or our own review, that you have posted objectionable content or behaved abusively (see Sections 5, 6.1 and 7);
  • we are required to by law, or by a rights holder, platform or regulator;
  • your use puts other users, us, or our infrastructure at risk; or
  • we discontinue the social features or the App entirely.

Statement of reasons. Whenever we remove your content, restrict a feature, suspend your account or terminate it, we will tell you what we did, what content or conduct it concerned, and which rule it engaged — unless the law forbids us from telling you, or telling you would prejudice a criminal investigation or someone's safety.

Your right of appeal — unconditional. You may appeal any content removal, feature restriction, suspension or termination, whatever the reason for it, by emailing info@montyinc.net with the word "APPEAL" in the subject line. You may appeal for six months from the date we tell you about the decision. We will review every appeal, a human will consider it, we will not decide it in an arbitrary or discriminatory way, and we will give you a reasoned reply — normally within 14 days. If your appeal succeeds we will restore the content or the account. Reinstatement beyond that is at our discretion, and this appeal route does not affect any right you have to complain to a court, a regulator, or an out-of-court dispute settlement body where the law where you live gives you one.

Termination does not affect your local library on your device. Sections 4 (responsibility for your content), 8 (licence, to the extent it survives), 10, 12, 13, 14, 15, 16, 17 and 18 survive termination.

11.3 By us, of the App itself

The App is provided without any commitment to keep it running. We may change, suspend or discontinue any feature — including the entire social layer — at any time, with or without notice, and without liability to you. Because your library is stored on your device, the tracking side of the App can continue to work locally even if our backend is switched off, though third-party metadata refreshes depend on providers we do not control. Export a backup if you want your data preserved independently of us.

12. Privacy

Our handling of personal data is described in our Privacy Policy at https://tvapp.montyinc.net, which is incorporated into these Terms by reference and is linked from Settings → Legal inside the App.

In brief: the App works fully without an account and keeps your library on your device; signing in shares your watch activity with your followers and makes your comments visible to signed-in users; friend matching reads only the email addresses in your address book, hashes each one on your device with SHA-256, and sends only those hashes — no phone number is read, hashed or transmitted at all; there are no analytics, advertising, tracking or crash-reporting SDKs in the App; and there is no tracking across other companies' apps or websites.

One thing worth repeating here: if you turned on episode notifications, you may also receive social push notifications (a new follower, an upvote on your comment, a reply on an episode you commented on) without a second permission prompt, because iOS grants notification permission once per app. You can turn notifications off entirely in iOS Settings.

13. Feedback

If you send us ideas, bug reports or suggestions, you grant us an unrestricted, perpetual, royalty-free right to use them without obligation or compensation to you. Please do not send us anything you consider confidential.

14. DISCLAIMER OF WARRANTIES

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS WHAT YOU CAN EXPECT FROM THE APP.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

To the maximum extent permitted by law, Monty Inc and its suppliers and licensors disclaim all warranties, express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy and non-infringement, and any warranties arising from course of dealing or usage of trade.

Without limiting that, we do not warrant that:

  • the App will be uninterrupted, timely, secure, error-free or available at any particular time;
  • defects will be corrected;
  • the App is free of viruses or other harmful components;
  • any show, episode, movie, air-date, cast, artwork or rating information is accurate, complete or current — see Section 10.1;
  • notifications will be delivered, delivered on time, or delivered at all;
  • your data stored on your device will be preserved, or that a backup or import will succeed or be complete;
  • the screening described in Section 6.1 will catch every prohibited comment, or that it will never refuse a comment you consider acceptable;
  • content posted by other users is accurate, lawful, inoffensive or safe; or
  • the App will meet your requirements.

You use the App at your own risk, and you are solely responsible for any damage to your device or loss of data that results. No advice or information, whether oral or written, obtained from us or through the App, creates any warranty not expressly stated here.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing here limits any non-waivable statutory rights you have as a consumer.

15. LIMITATION OF LIABILITY

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS WHAT WE OWE YOU IF SOMETHING GOES WRONG.

To the maximum extent permitted by law:

(a) No indirect damages. Monty Inc and its officers, employees, suppliers and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, or the cost of substitute services, arising out of or relating to the App or these Terms — even if we have been advised of the possibility of such damages, and regardless of the legal theory (contract, tort, negligence, strict liability or otherwise).

(b) Specifically excluded. Without limiting (a), we are not liable for: loss or corruption of your on-device library or backup files; a notification that did not arrive; a missed episode, premiere or air date; any decision you made in reliance on third-party metadata; the content, conduct or consequences of anything another user posts; anything a third-party service (including TVmaze, Apple, GIPHY, TMDB, our hosting provider or the push delivery service) does, fails to do, or does with data it receives; or unauthorised access to your account resulting from your device or Apple ID being compromised.

(c) Cap. Our total aggregate liability for all claims relating to the App or these Terms will not exceed the greater of (i) the total amount you actually paid us for the App in the twelve months before the event giving rise to the claim, or (ii) US $50. The App is currently offered free of charge, so in most cases this cap is US $50.

(d) What is never excluded. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and your non-waivable consumer rights are unaffected.

(e) Basis of the bargain. The disclaimers in Section 14 and the limits in this Section 15 are a fundamental part of the agreement between us and reflect the fact that the App is provided free of charge.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Monty Inc and its officers, employees, suppliers and licensors from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of: (a) Your Content; (b) your use or misuse of the App; (c) your breach of these Terms or of any law; or (d) your violation of any third party's rights. We may assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with us.

17. Apple-specific terms

These Terms are between you and Monty Inc only, not with Apple Inc. ("Apple"). You acknowledge and agree that:

  1. Apple is not a party to these Terms, and Monty Inc — not Apple — is solely responsible for the App and its content.
  2. These Terms may not provide for usage rules for the App that conflict with the App Store Terms of Service or the Apple Licensed Application End User Licence Agreement (the "Standard EULA") in effect at the date of these Terms. These Terms supplement the Standard EULA and are intended to be no less protective of the user than it is. To the extent these Terms grant you fewer rights than the Standard EULA, or conflict with it, the Standard EULA governs for that conflict. The Standard EULA is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
  3. The licence granted in Section 9 is a non-transferable licence to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
  4. Apple has no obligation whatsoever to provide any maintenance or support services for the App. If you have any maintenance or support questions, contact Monty Inc at info@montyinc.net, not Apple.
  5. Apple has no warranty obligation with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
  6. Monty Inc, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection, privacy or similar legislation; and (iv) claims that the App infringes a third party's intellectual property rights, the defence, settlement and discharge of which is Monty Inc's sole responsibility.
  7. You represent and warrant that (i) you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  8. If the App is acquired by or on behalf of the US Government, it is a "commercial item" as defined in 48 C.F.R. §2.101, licensed with only those rights granted to all other end users under these Terms.
  9. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

The developer of the App, for the purposes of Apple's minimum EULA terms, is Monty Inc, whose name, postal address and contact details are set out in Section 19. Direct all questions and complaints about the App there, not to Apple.

Sign in with Apple is provided by Apple and governed by Apple's own terms and privacy policy. If you choose Apple's "Hide My Email" option, we only ever receive the private relay address, and one consequence is that friends searching their contacts for your real email address will not find you.

18. General

Governing law. These Terms and any dispute arising out of them or the App are governed by the laws of Belgium, without regard to its conflict-of-laws rules. The courts located in Belgium have exclusive jurisdiction, and you consent to their personal jurisdiction and venue — except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and any right to bring proceedings in the courts of your place of residence under the law that applies to you. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Entire agreement. These Terms, together with the Privacy Policy and (where it applies) Apple's Standard EULA, are the entire agreement between you and Monty Inc about the App, and supersede any prior understanding.

Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the rest stays in force.

No waiver. Our failure to enforce a provision is not a waiver of it.

Assignment. You may not assign or transfer these Terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.

No agency. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between us.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including the failure of a third-party service the App depends on.

Headings and summaries. Headings and the "short version" at the top are for convenience only and do not affect interpretation.

Language. These Terms are drafted in English. Any translation is provided for convenience; the English version governs.
